House Bill No. 99 - Banking Law Revisions

• Repeals 11 outdated sections of Idaho banking code relating to bank facilities, director removal powers, penalties, and administrative procedures that have been preempted by federal law or no longer reflect current practices.

• Adds new section 26-302 authorizing banks to establish loan production offices with notice to the director; loan production offices may solicit loans and conduct loan-related activities but cannot accept deposits or disburse funds.

• Creates new enforcement authority in section 26-1114 allowing the director to suspend or remove bank directors, officers, or employees found dishonest, reckless, or engaged in unsafe practices, and prohibits removed individuals from future employment at state-supervised financial institutions.

• Establishes civil money penalties up to $1,000 per day for violations of banking law through new section 26-1115; consolidates cease and desist authority and permits the director to seek injunctive relief and other remedies in court under section 26-1116.

• Adds section 26-1202 prohibiting unauthorized use of banking-related names unless chartered or waivered by the director; makes willful violation a felony offense.
