House Bill 127 - Annexation by Cities Summary

• Establishes state policy that Idaho cities may annex reasonably necessary lands to enable orderly development and efficient provision of tax-supported and fee-supported municipal services

• Classifies annexations into three categories: Category A (all landowners consent or residential enclaves under 100 parcels), Category B (less than 100 ownerships or more than 100 with 50% consent), and Category C (more than 100 ownerships without majority consent)

• Requires written consent for annexation to be recorded in county recorder's office, with exceptions for enclaved lands and lands connected to city water/wastewater systems before July 1, 2008

• Mandates Category B annexations include written annexation plan addressing municipal services, taxation impacts, fee services, effects on other governments, and future land use; requires 28-day notice and public hearing with one-page summary mailed to property owners

• Allows Category C annexations only upon completion of Category B procedures and receipt of written consent from owners of majority of land area within 45 days of mailed notice
