Altering fireworks or selling/using fireworks at prohibited times constitutes an infraction punishable by a $100 fine.

Throwing fireworks from, into, or at a moving vehicle or person remains unlawful but penalty classification is not specified in this amendment.

Using fireworks in severe fire threat areas as determined by county commission or authority having jurisdiction remains prohibited.

All other fireworks violations under the chapter remain classified as misdemeanors, except those specifically designated as infractions in Section 39-2609.

Section 39-2613 is amended to clarify that misdemeanor penalties apply except as provided in Section 39-2609, and authorities may confiscate fireworks used in violation of the chapter.
