Prohibits real estate brokers and salespersons from splitting commissions, fees, or compensation with unlicensed persons, except when paying unlicensed legal business entities whose owners are all active real estate licensees who performed the licensed activities.

Allows Idaho licensees to pay commissions directly to buyers or sellers in a transaction, but prohibits splits that create double contracts or mislead brokers, lenders, title companies, or government agencies about fund sources or financial obligations.

Permits sales associates to accept payment from unlicensed entities if the payment was authorized and paid by the broker in accordance with fee-splitting rules.

Allows brokers to pay former sales associates for services performed while they were actively licensed, regardless of their current license status at the time of payment.

Prohibits finder's fees to unlicensed persons for securing real estate prospects and maintains existing prohibitions on kickbacks, rebates, and after-the-fact referral fees.
