Senate Bill 1062 - Idaho Direct Primary Care Act

• Establishes Chapter 92, Title 39, Idaho Code, creating the "Idaho Direct Primary Care Act" to recognize direct patient-provider agreements as non-insurance arrangements.

• Defines direct primary care agreements as written contracts between licensed primary care providers (pediatrics, family medicine, internal medicine, or dentistry) and individual patients for periodic fees rather than per-visit charges.

• Requires direct primary care agreements to identify the provider and patient, scope of services, service locations, direct fee amount and payment schedule, and termination conditions, with agreements terminable at will by patient written notice.

• Prohibits billing to insurers for services under direct primary care agreements and exempts such agreements from regulation under Idaho insurance law (Title 41).

• Requires agreements to include a disclaimer stating they do not provide health insurance coverage including minimal essential coverage under federal law, and restricts transfers of agreements to other primary care providers only with patient written consent.
