SB 1095 Summary

• Establishes a risk-based sexual offender registration system with five (5) levels to replace the previous violent sexual predator designation, with the Sexual Offender Management Board developing procedures by July 1, 2016.

• Creates default registration levels: Level 4 for offenders not yet reviewed by the board, and Level 5 for those convicted of aggravated offenses, repeat offenders, or previously designated violent sexual predators.

• Sets registration frequency and terms based on risk level: Level 1-3 register annually (10-30 year terms), Level 4 registers biannually (40-year term), and Level 5 registers quarterly (lifetime).

• Allows offenders (except Level 5) to petition for release from registration requirements after serving one-half of their registration term, with board review and hearing procedures including psychosexual evaluation requirements.

• Modifies information disclosure provisions to restrict public access to Level 1 offender registry information while maintaining law enforcement and school access, and updates child welfare and parental termination provisions related to sexual offenses.
