Courts must charge surcharge fees to defendants found or pleading guilty for criminal offenses or infractions committed on or after April 15, 2010, in addition to all other fines and fees.

Surcharge fee amounts are $100 per felony, $50 per misdemeanor, and $10 per infraction.

The state treasurer shall deposit 80% of collected surcharge fees into the drug court, mental health court and family court services state general fund and 20% into the court technology fund.

Moneys from the surcharge fees shall be used by the supreme court for operations of drug courts and mental health courts, including drug testing, substance abuse treatment, mental health assessment, and family court services.

Section 1-1625, Idaho Code was amended to add surcharge fee collections under section 31-3201H as a source of funding for the drug court, mental health court and family court services fund.
