Pharmacists who dispense a biological product must communicate the drug name and manufacturer to the prescriber within 5 business days via electronic medical records, e-prescribing technology, pharmacy benefit management system, or pharmacy records accessible electronically to the prescriber.

Communication requirement does not apply when no interchangeable biological product is approved by the FDA for the prescribed product, when a refill uses the same product as the previous fill, or when the pharmacist previously confirmed the specific product with the prescriber before dispensing.

Dispensing of valid prescriptions for biological products cannot be delayed due to communication requirements.

"Biological product" is defined according to 42 U.S.C. 262(i), and "interchangeable biological product" means a product licensed by the FDA as interchangeable under 42 U.S.C. 262(k)(4) or deemed therapeutically equivalent in the FDA's "Approved Drug Products with Therapeutic Equivalence Evaluations."

The law includes a sunset date and becomes null and void on July 1, 2026.
