Idaho State Police Forensic Services Laboratory must test all sexual assault evidence kits unless an adult victim expressly declines or no crime is supported, with exceptions requiring independent county prosecutor review.

Health care facilities must notify local law enforcement when evidence kits are collected, and law enforcement must submit kits to the state lab within 30 days; the state lab must complete testing and submit eligible results to the Idaho DNA database within 90 days.

Idaho State Police must create a tracking process for all sexual assault evidence kits and provide kits at no cost to health care facilities and law enforcement agencies; all law enforcement agencies must conduct a one-time audit of untested kits within 180 days and report findings.

Victims have the right to written notification when kits are submitted to the lab, when DNA profiles enter the database, and when DNA matches occur; county prosecutors must notify victims of any planned evidence destruction or case status changes.

Idaho State Police must submit annual reports to the legislature beginning January 20, 2017, detailing kit distribution, collection, testing numbers, database hits, and compliance by law enforcement agencies, with information provided in aggregate form without victim or suspect names.
