Courts may award joint physical custody, joint legal custody, or both between parents as determined to be in the child's best interests, and must state reasons if declining either form of joint custody.

"Significant periods of time" for joint physical custody means as near to equal as practicable but does not require exactly equal time or alternating schedules; the court determines the actual amount of time with each parent.

Establishes a presumption that joint physical and joint legal custody is in the best interests of a minor child unless proven otherwise by a preponderance of evidence.

Rebuts the joint custody presumption if the court finds one parent is a habitual perpetrator of domestic violence as defined in Idaho Code section 39-6303.
