Council on Developmental Disabilities shall consist of 23 members appointed by the governor, with at least 60% being individuals with developmental disabilities, parents or guardians of children with developmental disabilities, or immediate relatives or guardians of adults with developmental disabilities who cannot advocate for themselves.

Minimum of 5 members must be persons with a developmental disability and minimum of 7 members must be parents or guardians of such persons, with an additional member being either a person with a developmental disability or parent of a child with a developmental disability.

Council members who are parents, guardians, or persons with developmental disabilities cannot be employees of a state agency that receives funds or provides services under P.L. 106-402 or managing employees of any other entity receiving such funds or services.

Principal state agencies administering funds under the Rehabilitation Act of 1973, Individuals with Disabilities Education Act, Older Americans Act of 1965, and Titles V and XIX of the Social Security Act shall be represented on the council.

Council shall also include representation from the state protection and advocacy organization and the university center for excellence in developmental disabilities education, research and service, with geographic representation and diversity reflecting the state's racial and ethnic composition.
