Amends Section 39-107C, Idaho Code to clarify that moneys donated, bequeathed, devised or conditionally granted to the Department of Environmental Quality shall be held in the Environmental Protection Trust.

Establishes the "Environmental Protection Trust Fund" in the state treasury consisting of moneys held in the environmental protection trust.

Allows surplus moneys in the environmental protection trust fund to be invested either by the state treasurer per Section 67-1210, Idaho Code, or with the endowment fund investment board under Chapter 7, Title 57, Idaho Code, with concurrence of the department director, state treasurer, and endowment fund investment board.

Requires interest received on all investments to be paid into the environmental protection trust fund.

Provides that trust moneys shall be used to carry out the terms and conditions of donations, bequests, devises or grants, and to pay costs and expenses arising from investment of the trust.
