Adds new subsections (4) and (5) to Idaho Code Section 33-504 governing board of trustees vacancies when trustees are subject to recall elections.

When a trustee subject to recall resigns within 5 days after notice from the county clerk, remaining trustees subject to recall cannot be counted toward a quorum or vote to fill the vacancy until after recall election results.

If a trustee subject to recall resigns after the 5-day period, the position remains vacant until recall election results if the board has a quorum, or the governor appoints someone to maintain a quorum.

Trustees subject to pending recall elections cannot participate in filling board vacancies until the results of their own recall elections are determined, even if other trustees resign or are recalled.

Declares an emergency, making the act effective upon passage and approval.
