Peace officers in Idaho may issue citations to persons who violate invasive species provisions under section 19-3901, Idaho Code and by rule of the supreme court.

Peace officers may require vehicles to stop and submit to inspection of exterior conveyances upon reasonable suspicion of infestation with quagga mussels or zebra mussels.

When probable cause exists that a conveyance is contaminated with quagga or zebra mussels, peace officers shall detain the vehicle and either summon a tow truck to an impound yard or accompany the vehicle to an inspection station for cleaning and disinfecting.

Violations of the invasive species chapter constitute an infraction rather than a misdemeanor, with no violation points assessed and not deemed a moving traffic violation for insurance rate purposes.

Civil penalties for violations may be assessed by the department at up to $10,000 per offense, with all collected penalties remitted to the invasive species fund.
