S.B. 1387 Summary

• Adds definition of "durable medical equipment supplier" to Idaho Code § 54-1705, specifying entities that bill or plan to bill Medicare for durable medical equipment, prosthetics, orthotics and supplies in competitive bid categories.

• Clarifies the Idaho State Board of Pharmacy's authority to regulate durable medical equipment and related supplies under § 54-1719.

• Requires durable medical equipment suppliers selling specified high-risk products (oxygen equipment, ventilators, wheelchairs, orthoses, prosthetics, and other medical devices) to maintain an accredited physical facility meeting federal standards and be located in Idaho or within 150 miles of served customers.

• Exempts certain entities from durable medical equipment supplier requirements including insulin pump suppliers, Medicare mail order program suppliers, certain pharmacies, and practitioners supplying equipment to their own patients.

• Corrects code references in sections 37-3201, 54-1761, and 54-4702 to point to the correct definition of "legend drug" in § 54-1705(38).
