Revises the definition of "dessert wine" to clarify it includes beverages labeled as "sherry," "madeira," or "port" containing more than 16% but not exceeding 21% alcohol by volume.

Removes the requirement that applicants for retail wine licenses or wine by the drink licenses must possess a retail beer license issued by the director.

Exempts licensed wineries from the retail beer license prerequisite for obtaining a separate retail wine license or wine by the drink license for sales at the winery's original licensed premises or other locations.

Requires the director to conduct criminal history background checks using fingerprints and Idaho and federal criminal history databases when determining applicant qualification for licenses.

Declares the act an emergency measure effective upon passage and approval.
