Governor of Idaho authorized to appoint up to two (2) alternate commissioners to the Bear River Commission, in addition to three (3) primary commissioners representing Idaho on the joint commission with Wyoming, Utah, and the United States.

Director of the Department of Water Resources may serve as one (1) of the three primary commissioners.

Alternate commissioners have authority to perform all duties of appointed commissioners when primary commissioners are absent.

Commission members have authority to investigate Bear River and tributaries, determine physical conditions, assess current and future water needs for Idaho, and secure information necessary to negotiate compacts and agreements regarding water diversion, distribution, utilization, and regulation.

Any compact or agreement negotiated on behalf of Idaho requires ratification and approval by the legislatures of Idaho, Wyoming, Utah, and by Congress.
