House Bill 125 Summary

• Repeals Chapter 1, Title 51 Idaho Code (Idaho Notary Public Act) and Chapter 7, Title 55 Idaho Code (Acknowledgments) and replaces with Revised Uniform Law on Notarial Acts effective July 1, 2017

• Establishes requirements for notary public commissions including $10,000 surety bond, oath of office, examination (effective July 1, 2019), and 6-year term issued by Secretary of State

• Authorizes notary public services including acknowledgments, oaths, verifications, signature witnessing, copy certification, and protest noting; requires personal appearance and satisfactory identification

• Permits notary public use of electronic records with tamper-evident technology approved by Secretary of State; establishes official stamp and stamping device requirements

• Sets notary public filing fees ($30 application, $20 electronic authorization) and notary service fees (maximum $5 per notarial act plus travel expenses); prohibits notaries from practicing law or immigration services
