School district boards of trustees are empowered to negotiate agreements with local education organizations representing a majority of professional employees upon either party's request.

Local education organizations must provide written evidence to the district that they represent 50% plus one (1) of professional employees prior to commencement of negotiations, which the board may request on an annual basis.

The required evidence must demonstrate that within the last two (2) years, the organization held a secret ballot election counted by an independent third party in which a majority approved representation.

Accurate records and minutes of negotiation proceedings must be kept and made available for public inspection at the school district office during normal business hours.

All final settlement offers must be jointly ratified in open meetings, with each party providing written evidence to the other confirming that majority ratification has occurred.
