Elected officials are made ineligible for cash compensation or compensatory time for overtime work across all three amended sections of Idaho Code.

Executive-level classified and nonclassified employees remain ineligible for compensatory time or cash compensation for overtime, except during disasters or emergencies approved by the board of examiners.

Administrative or professional employees designated under the federal Fair Labor Standards Act are ineligible for cash compensation for overtime but may accrue compensatory time off at a one-to-one ratio, capped at 240 hours.

Non-exempt classified employees continue to be eligible for either cash compensation or compensatory time off for overtime work at the discretion of the appointing authority, with compensatory time paid at one and one-half hours per overtime hour worked.

Unused compensatory time balances are subject to forfeiture timelines and are non-transferable upon separation from state service or transfer to another state agency.
