Filing fee of $5.00 per parcel plus exclusion fees ($25.00 for subdivided lots under one acre, $50.00 for non-subdivided parcels under one acre, and $50.00 per acre for larger parcels) must accompany petition for exclusion from irrigation district.

Filing and exclusion fees are borne by petitioner and are not apportionable costs; petitioners must also pay outstanding assessments levied in the calendar year the petition is filed for those assessments to create a lien.

Hearings on exclusion petitions must be held within 150 days of filing; if no hearing is held within this timeframe, land is automatically excluded from district.

Petitioner or previous owners must have paid district assessments against land for exclusion cost exceptions to apply when land is too high for irrigation or lacks delivery system access for five irrigation seasons preceding petition.

If petitioner is required to pay exclusion hearing costs, board may require deposit of estimated costs before hearing; excess deposits must be refunded within 14 days after hearing, and balance owed must be paid within 14 days of receiving cost statement.
