HB 406 Summary

• Amends Idaho Code Section 39-7403 to add definition of "organic waste material" as the organic portion of solid waste including food scraps, food processing residuals, and soiled or unrecyclable paper separated from nonorganic material.

• Creates new Section 39-7422 establishing state policy for organic waste management with priority order: source reduction, food consumption by humans, agricultural use, composting/land application/digestion, then energy recovery.

• Requires cities and counties to develop plans promoting waste reduction, reuse, closed-loop recycling, and integrated waste management systems that reduce reliance on landfill disposal.

• Mandates separate collection of leaf and yard residuals beginning July 1, 2019, and food residuals beginning July 1, 2020, delivered to facilities managing these materials consistent with established priorities.

• Establishes phased applicability thresholds for food residual separation requirements starting at 104 tons per year in 2019, declining to any amount generated by July 1, 2023.
