Idaho Board of Pharmacy issues cannabidiol oil registration cards to individuals at least 18 years old with a practitioner statement indicating the individual may benefit from cannabidiol oil treatment for an illness.

Parents or legal guardians of minors may obtain registration cards for their children upon presentation of a neurologist's statement that the minor may benefit from cannabidiol oil treatment.

Registration cards are valid for one year and may be renewed following the same application process.

Individuals with valid registration cards may legally possess and use cannabidiol oil defined as a product containing primarily cannabidiol with trace amounts of tetrahydrocannabinol that produces no psychoactive or hallucinogenic effect.

Lawful possession requires obtaining cannabidiol oil from a sealed, labeled container with a corresponding certificate of analysis from an independent laboratory showing ingredient percentages and place of origin.

Parents or legal guardians registered with the board may administer cannabidiol oil to minors with intractable epilepsy without criminal or civil penalties.

Act becomes effective January 1, 2019.
