HB 445 - Wine Label Amendments

• Adds definitions for "personalized label" (customized for individual consumers) and "customized private label" (customized for hotels or restaurants) to Idaho Code Section 23-1303, with both requiring approval from the federal Alcohol and Tobacco Tax and Trade Bureau.

• Allows wineries and vintners to furnish wine with personalized labels to consumers upon request, provided the consumer pays all costs and the wine product is otherwise available under another label at the same price.

• Allows wineries and vintners to furnish wine with customized private labels to hotels or restaurants with retail wine licenses upon request, with the same cost-sharing and pricing requirements as personalized labels.

• Requires wineries and vintners to maintain sales records for personalized and customized private label wines for two years, including customer name, quantity, date, price, production costs, and a specimen label, made available to the director upon request.

• Permits distributors and importers to assist in delivering personalized and customized private label wines without violating prohibitions on aiding retailers, and exempts these labeled wines from standard distributor restrictions on retailer sales.
