House Bill 545 - Wine Labeling Summary

• Defines "personalized label" as a wine container label customized for an individual consumer and "customized private label" as a label customized for a hotel or restaurant, both subject to federal approval and meeting minimum mandatory label requirements.

• Allows wineries and vintners producing not more than 25,000 gallons annually to furnish wine with personalized labels to consumers at the consumer's expense, provided the wine product is otherwise available to all Idaho retailers and consumers under another label at the same price.

• Permits wineries and vintners producing not more than 25,000 gallons annually to provide wine with customized private labels to hotels or restaurants with retail wine licenses at the establishment's expense, with the same pricing and availability requirements as personalized labels.

• Requires wineries and vintners to maintain records of all personalized and customized private label sales for two years, including customer name, quantity, dates, price, production costs, and label specimens, made available to the director upon request.

• Exempts personalized and customized private label wines from distributor restrictions on resale to single retailers and allows distributors or importers to assist in delivery of such labeled wines to hotels and restaurants.
