HB 623 Summary

• Creates a new Office of Administrative Hearings within the Department of Self-Governing Agencies with a Chief Administrative Hearing Officer and hearing officers to conduct all contested case proceedings statewide

• Establishes comprehensive procedures for contested cases including commencement, evidence rules, discovery, default, hearing records, emergency adjudication, ex parte communication restrictions, and subpoena issuance

• Reorganizes judicial review provisions with new sections covering standing, exhaustion of administrative remedies, record on review, and standards of review for final agency orders

• Adds new sections for reconsideration requests, stays pending appeal, availability and indexing of final orders, and procedures for actions against licensees

• Effective dates: Sections 33-42 effective July 1, 2018; Section 38 (advisory council) expires July 1, 2023; remaining sections effective January 1, 2019
