AI Summary

  • Water rights for livestock use on federally owned or managed grazing land are designated as appurtenances to the base property.

  • When a federal grazing permit is transferred to a new owner, the associated stockwater rights may be conveyed and become appurtenant to the new owner's base property upon approval of a transfer application.

  • Priority dates for livestock water rights are established as the first date water was historically used for livestock watering on the land, subject to existing statutory provisions.

  • No change in use of any water right for livestock watering may be made without consent of the federal grazing allotment permittee, if any.

  • The bill promotes watering of livestock away from streams and riparian areas but does not require fencing of livestock away from such areas.

Legislative Description

Amends existing law to provide that for rights to the use of water for in-stream or out-of-stream livestock purposes associated with grazing on federally owned or managed land established under the diversion and application to beneficial use method of appropriation, the water right shall be an appurtenance to the base property.
