HB 23 Summary

• Enacts the "Idaho Code of Military Justice" as the Model State Code of Military Justice, establishing comprehensive military justice procedures for Idaho state military forces.

• Applies to all state military forces members in Title 32 or state active duty status, with jurisdiction over both military and nonmilitary offenses with nexus to the state military forces.

• Establishes three types of courts-martial (general, special, and summary) with detailed procedures for charges, investigations, trials, sentencing, and appeals through district courts.

• Defines military offenses (Articles 77-134) covering conduct from desertion and absence without leave to fraud, bribery, and general articles affecting military discipline and good order.

• Provides protections including victim rights, investigation procedures, right to counsel, nonjudicial punishment alternatives, and comprehensive post-trial review processes by senior judge advocates and appellate authorities.
