SB 1011 Summary

• Amends definitions in Idaho Code Chapter 55-2202 to add "excavator downtime" (lost time due to stakeholder non-compliance), clarify "hand digging" and "soft digging" methods, and refine definitions of locatable and identified facilities.

• Revises Section 55-2205 to allow excavators to receive compensation from underground facility owners for costs incurred when owners fail to locate facilities in accordance with the law, and allows owners to receive compensation for notices given less than two business days in advance.

• Caps excavator compensation for standby costs at $2,000 or actual costs (whichever is less) when underground facility owners provide locate information within eight hours of notification of unidentified facilities.

• Modifies Section 55-2208 to expand reporting requirements so that underground facility owners and excavators must report excavator downtime caused by any stakeholder's failure to comply with damage prevention regulations to the damage prevention board.

• Clarifies that data reporting to the board does not constitute a formal complaint under Idaho Code Section 55-2211.
