Senate Bill 1111 Summary

• Adopts the 2018 Revised Uniform Law on Notarial Acts, replacing the previous version, with updates to Idaho Code Chapter 1, Title 51.

• Authorizes notary publics to perform notarial acts for remotely located individuals using communication technology (simultaneous sight and sound) if identity is verified through personal knowledge, credible witness testimony, or at least two types of identity proofing.

• Requires notary publics performing remote notarial acts to create and retain audio-visual recordings for at least 10 years and notify the Secretary of State before performing their first remote notarial act.

• Permits notary publics to certify that tangible copies of electronic records are accurate copies, and allows recorders to accept tangible copies of electronic records with notarial certificates in place of originals.

• Directs the Secretary of State to adopt rules establishing standards for communication technology, identity proofing, and recording retention for remote notarial acts, effective January 1, 2020.
