Removes the prohibition on using eminent domain to acquire private property for trails, paths, greenways, or other ways for walking, running, hiking, bicycling, or equestrian use, unless adjacent to a highway, road or street.

Maintains existing limitations on eminent domain use for private parties, urban renewal, and economic development purposes.

Preserves exceptions allowing eminent domain use pursuant to chapters 15 and 42 of Idaho Code and chapters 19, 20, and 29 of title 50, Idaho Code.

Maintains the requirement that property within urban renewal or deteriorated areas must meet clear and convincing evidence standards showing danger to life, health, safety, or public welfare before condemnation.

Makes technical corrections to existing statutory language in Section 7-701A, Idaho Code.
