House Bill 361 Summary

• Repeals existing Section 18-4016, Idaho Code and replaces it with the "Idaho Abortion Human Rights Act" that makes abortion unlawful for any person to perform, procure, or attempt to perform.

• Defines "abortion" as the use or prescription of any instrument, medicine, drug, or substance to intentionally kill an unborn human being, with "unborn human being" defined from the moment of conception through all stages including zygote, embryo, and fetus.

• Directs the Attorney General to monitor enforcement of abortion prohibitions and requires state agencies and political subdivisions to enforce the law regardless of conflicting federal statutes, regulations, executive orders, or court decisions.

• Provides immunity to mothers who assist in investigating or prosecuting persons for abortion-related conduct, and provides that medical practitioners attempting to save a pregnant patient's life are not guilty if the attempt unintentionally results in the death of an unborn human being.

• Makes the law non-retroactive, applying only to conduct occurring on or after the effective date, with offenses committed before the effective date governed by the prior law.
