House Bill 405 Summary

• Amends Idaho Code Section 19-3508 to establish eligibility requirements for DUI diversion programs in Idaho.

• Requires that a person charged with driving under the influence under sections 18-8004 or 18-8004A must not hold a commercial driver's license or commercial learner's permit and must not have been operating a commercial vehicle at the time of the alleged conduct.

• Prohibits participation if any other person is alleged to have been physically injured as a result of the conduct underlying the charge.

• Bars participation if the person has been convicted of driving under the influence or a substantially conforming foreign criminal violation within the past 10 years or has previously participated in a diversion program under section 19-3509.
