Cities with fewer than 100,000 inhabitants may, by ordinance, establish districts and elect councilmen by districts, while cities with more than 100,000 inhabitants must establish districts and elect councilmen by districts.

Districts must be established no later than 120 days prior to the general election following the date that election precincts are established and must consist of one or more contiguous election precincts with approximately equal population based on the most recent federal decennial census.

The number of districts established must correspond to the number of council seats determined by the city under Section 50-701 or Section 50-805, Idaho Code.

Within 90 days before the next general city election, the council must determine whether council members will be elected by electors from the entire city or by electors of their geographic district, and any candidate must be a resident of their geographic district.

For cities with fewer than 100,000 inhabitants that establish districts by ordinance, the council must also determine the method of implementation at least 90 days before the next general election.
