House Bill 452 - Idaho Right to Repair Act

• Creates the Idaho Right to Repair Act requiring original equipment manufacturers of digital electronic equipment sold in Idaho to make diagnostic and repair information available to independent repair providers and owners at no charge or on the same terms as authorized repair providers.

• Requires manufacturers to make service parts and diagnostic repair tools available for purchase by owners and independent repair providers upon fair and reasonable terms, with pricing based on factors including net cost, distribution costs, competitor pricing, and affordability for aftermarket technicians.

• Exempts motor vehicles and trucks covered by industry memoranda of understanding dated January 15, 2014 and August 12, 2015, and exempts any industry adopting similar comprehensive memoranda after July 1, 2020.

• Requires security-related equipment to include information necessary to reset security functions, either provided directly or through secure data release systems accessible to owners and repair facilities.

• Violations constitute violations of the Idaho Consumer Protection Act, and the law does not apply to trade secrets or agreements between authorized repair providers and manufacturers, except provisions waiving manufacturer compliance obligations are void and unenforceable.
