School districts and public charter schools may offer digital or online library resources to K-12 students only if vendors verify compliance with safety policies and technology protection measures.

Required safety measures must prohibit and prevent users from sending, receiving, viewing, or downloading materials deemed harmful to minors as defined in Idaho Code section 18-1514.

Digital and online library resources must filter or block access to obscene materials, materials harmful to minors, and materials depicting sexual exploitation of minors as defined in Idaho Code chapter 15, title 18.

School districts and public charter schools may withhold payments to noncompliant providers and may consider failure to timely verify compliance a breach of contract.

The Idaho Commission for Libraries must submit an aggregate written report by December 1 each year to the governor and legislature education committees on any provider compliance issues with technology protection measures.
