Prior to issuance of a permit, a cyanidation facility must submit a permanent closure plan for approval under chapter 15, title 47, Idaho Code.

After permanent closure plan rules take effect, the department shall not issue a permit unless financial assurance requirements have been satisfied and proof of financial assurance for the closure plan is provided.

Any issued permit shall prohibit construction and operation of the cyanidation facility until the permittee submits proof acceptable to the department that financial assurance for the permanent closure plan has been provided.

Before rules become effective, the department may issue permits if the facility provides financial assurance in an amount equal to estimated reasonable costs to complete closure activities plus 10 percent, avoiding duplication with other governmental agencies.

Cyanidation facilities with existing permits approved prior to July 1, 2005, remain subject to laws in effect on June 30, 2005, except material modifications or expansions after that date shall comply with all current provisions.
