Amends Section 34-1707, Idaho Code to revise notification and election procedures for recall petitions filed with the secretary of state, county clerk, city clerk, or special district governing board.

Requires the appropriate official to notify the officer being recalled and petitioner within 5 business days that a recall petition is in proper form; if the secretary of state is being recalled, the governor shall also be notified.

Allows the officer being recalled to resign within 5 business days of notice, in which case the resignation takes effect immediately and the vacancy is filled according to law.

If the officer does not resign within 5 business days, a special election must be ordered on the date prescribed in Section 34-106, Idaho Code, conducted statewide, by legislative district, countywide, or citywide depending on the office type.

Declares an emergency, making the act effective immediately upon passage and approval.
