Revises the definition of burglary in Idaho Code Section 18-1401 to exclude commercial establishments, which are now addressed separately under a new commercial burglary statute.

Creates a new crime of commercial burglary for entering a commercial establishment during business hours with intent to commit theft under $300.

First commercial burglary conviction is a misdemeanor punishable by up to 6 months in jail, a $1,000 fine, or both.

Second commercial burglary conviction within 5 years is a misdemeanor punishable by up to 1 year in jail, a $2,000 fine, or both.

Third or subsequent commercial burglary conviction within 5 years is a felony, regardless of whether prior judgments were withheld.
