Authorizes production, processing, and research of industrial hemp in Idaho consistent with federal law, requiring the director of agriculture to submit a state plan to the U.S. Department of Agriculture by June 15, 2020.

Establishes transportation regulations for industrial hemp, requiring licensed transporters to consent to inspections and sampling by peace officers to verify compliance with federal THC limits of 0.3% on a dry weight basis.

Creates graduated penalties for illegal hemp transportation or possession: first offense up to $150 fine, second offense up to $300 fine within 5 years, and third or subsequent offense up to $1,000 fine and/or 6 months county jail within 5 years.

Establishes an Industrial Hemp Development Fund to be funded by fees and civil penalties collected from hemp regulation and used solely for implementing the hemp program.

Declares an emergency, making the act effective immediately upon passage and approval.
