Authorizes Idaho State Police and Idaho Transportation Department to conduct visual inspections of diesel fuel tanks in commercial vehicles exceeding 26,000 pounds gross weight at fixed or portable check stations or during lawful traffic stops for suspected violations of other laws.

Prohibits random inspection stations established solely for dyed fuel testing and bars state agencies from reporting dyed fuel violations to federal government or using inspections as basis for further investigation of vehicle owners.

Establishes civil penalties for operating vehicles with dyed fuel on highways: $250 for first violation, $500 for second violation, and $1,000 for third or subsequent violations, with $1,000 penalty for inspection refusal.

Requires Idaho State Police and Transportation Department to enter into joint exercise of powers agreements by January 1, 2021, and to conduct six months of outreach and education on dyed fuel use before beginning inspections.

Directs legislature to evaluate the inspection program and associated funding after five years from the effective date and exempts dyed fuel use during governor or presidential disaster declarations when necessary for emergency assistance.
