Senate Bill 1388 Summary

• Driving privilege suspensions shall be vacated if criminal charges arising from the same occurrence are dismissed or vacated, and the suspension imposed under criminal provisions shall also be vacated.

• A person's driving privileges are restored on the effective date the criminal charges are vacated or dismissed.

• The bill applies to violations of sections 18-8004, 18-8004C, and 18-8006 of Idaho Code (alcohol and drug-related driving offenses).

• Both administrative suspensions under this section and criminal suspensions shall be vacated together when criminal charges are dismissed, rather than remaining in effect independently.
