Schools and accredited institutions of higher education, along with their trustees, employees, contractors, and agents, are protected from liability for COVID-19 transmission or contraction claims when acting within the scope of duties without malice, criminal intent, or reckless, willful, and wanton conduct.

"Accredited institution of higher education" includes public or private universities, colleges, community colleges accredited by the Northwest Association of Schools and Colleges, and public professional-technical schools operated by Idaho or its political subdivisions.

"School" includes Idaho public school districts, public charter schools, and accredited private or parochial schools serving students in kindergarten through grade 12.

"COVID-19" means severe acute respiratory syndrome coronavirus 2 or the disease caused by that virus.

The liability protections expire and become null and void on July 1, 2021, and the act takes effect immediately upon passage and approval.
