HB 39 Summary

• Transfers prescription tracking and controlled substances database functions from the State Board of Pharmacy to the Idaho Division of Occupational and Professional Licenses.

• Requires all prescribers (except veterinarians) and pharmacists to register with the division annually to obtain online access to the controlled substances prescriptions database.

• All controlled substances dispensed for humans must be filed electronically with the division in a format established by rule; database information retained for five (5) years from date of dispensing.

• Maintains existing privacy protections and access restrictions for the database, limiting disclosure to authorized individuals including law enforcement, practitioners, pharmacists, patients, and those with lawful court orders.

• Makes technical corrections and definitional amendments to align references throughout Chapter 37-27 of Idaho Code with the administrative transfer to the division.
