HB 40: Idaho Pharmacy Act Update

• Consolidates and modernizes Idaho's pharmacy regulations by amending 25 sections and repealing 6 sections of the Idaho Pharmacy Act (Chapter 17, Title 54).

• Replaces "license" and "registration" terminology with unified "certificate" language throughout pharmacy regulatory provisions for clarity and consistency.

• Establishes new licensure requirements for wholesale drug distributors, requiring designated representatives to be actively involved in daily operations and undergo criminal history checks.

• Expands pharmacist prescribing authority to include agents for active immunization and certain legend drugs for minor, self-limiting conditions without requiring a new diagnosis.

• Allows multistate pharmacist licensure through mutual recognition agreements with other states that have substantially similar requirements for licensure and criminal background checks.
