House Bill 52 Summary

• Prohibits mental health professionals from providing conversion therapy to patients or clients under 18 years of age, defined as practices or treatments seeking to change sexual orientation or gender identity.

• Conversion therapy does not include neutral mental health therapy that provides acceptance and support, assists with gender transition, facilitates coping and identity exploration, or addresses sexual conduct in a neutral manner.

• Violations of the conversion therapy prohibition constitute unprofessional conduct subject to disciplinary proceedings under Idaho Code Title 54.

• Exempts clergy members or religious counselors acting in a pastoral or religious capacity rather than as health care professionals.

• Exempts parents or grandparents who are health care professionals when acting substantially in a parental or grandparental capacity rather than as health care professionals.
