House Bill 98 Summary

• Requires disaster emergency declarations to be narrowly tailored and prohibits restrictions on the right of Idahoans to work or contribute to the economy based on job type or classification.

• Limits declared states of disaster emergency to 30 days initially, extendable for another 30 days, with a maximum of 60 days unless the legislature extends it by concurrent resolution.

• Allows the governor to extend emergency declarations beyond 60 days solely for purposes of receiving federal funding, benefits, and resources, but all other provisions expire unless the legislature extends by concurrent resolution.

• Prohibits the governor from altering, adjusting, or suspending any provision of the Idaho Code during a disaster emergency.

• Protects the lawful manufacture, possession, transfer, sale, transport, storage, display, and use of firearms and ammunition, and the rights to peaceable assembly and free exercise of religion during any state of disaster emergency.
