House Bill No. 287 - Homeowner's Association Act

• Repeals existing homeowner's association provisions in Idaho Code sections 45-810, 55-115, and 55-116 and creates a new comprehensive Homeowner's Association Act in Chapter 32, Title 55.

• Requires board meetings to be open to members with at least 48 hours' notice, allows email notice, and mandates statement of account within 5 business days upon request with no fees for expedited statements.

• Establishes due process protections for fines including 30-day written notice, majority board vote requirement, and prohibition on fines if member begins resolving violation in good faith; allows court review of attorney's fees reasonableness.

• Creates homeowner's association liens limited to unpaid assessments from the previous 12 months with specific filing, recording, and notice requirements; liens may be enforced through board action.

• Prohibits restrictions on solar panels (except location), political signs, and certain flags (U.S., Idaho, POW/MIA, and armed forces flags) while allowing reasonable regulations on size, placement, and condition; requires 3 days' notice before removal.
