Recall elections for school district trustees shall be held on election dates authorized in section 34-106(9), Idaho Code, instead of the uniform election date for regular trustee elections.

When a trustee is recalled or resigns following a prospective recall petition, any resulting vacancy shall be filled by election on the next available election date under section 34-106(1) or (7), Idaho Code, at least 45 days after the county clerk orders the election.

If a recalled trustee vacancy election will occur within 90 days of the clerk's order, the seat remains vacant during that period; if the election occurs after 90 days, a temporary trustee shall be appointed within 30 days to serve until the newly elected trustee takes office.

In cases where multiple trustees are recalled and the board loses its quorum, county commissioners shall appoint only the minimum number of temporary trustees necessary to restore the board's ability to conduct business until the next election date.

The act takes effect immediately upon passage and approval as an emergency measure.
