School trustee recall elections must be held on an election date authorized in section 34-106(9), Idaho Code, rather than on the regular trustee election date.

When a trustee is recalled or resigns following a prospective recall petition filing, the vacancy must be filled by an election held on the next available election date at least 85 days after the county clerk orders the election.

If the recall-related election will be held within 100 days of the clerk's order, the seat remains vacant until the election; if held after 100 days, a temporary trustee is appointed according to modified timelines (30 days instead of 90 days, and 60 days instead of 120 days).

If multiple trustees are recalled and the board loses quorum, the board of county commissioners may appoint only the minimum number of temporary trustees needed to restore quorum until the next election date.

The act takes effect immediately upon passage and approval as an emergency measure.
